  • Leased worker: A leased worker is an individual with full civil capacity, recruited and contracted by the labor leasing enterprise, then transferred to work and is under the management of the labor user.

According to the provisions of Article 52 of the Labor Code 2019: The activity of labor subleasing is a conditional business sector, only to be carried out by enterprises holding a License for Labor Subleasing and applies to certain specified jobs.

According to the provisions of Article 54 of the Labor Code 2019:

  • Enterprises engaging in labor subleasing must establish a reserve fund and obtain a License for Labor Subleasing.
  • Compliance with the reserve fund and the list of sectors as stipulated by the Government.

  •  The maximum duration of labor subleasing for employees is 12 months.
  • The labor subleasing party may utilize subleased labor in the following cases:
  • Temporarily meeting sudden increases in labor demand for a specified period;
  • Replacing employees during maternity leave, work-related accidents, occupational diseases, or when fulfilling civic duties;
  • Having the need for labor with specialized skills and high technical qualifications.
  • The labor subleasing party may not use subleased labor in the following cases:
  • To replace employees currently exercising their right to strike, resolving labor disputes;
  • Without specific agreement on the responsibility for compensating for work-related accidents, occupational diseases of the subleased employees with the labor subleasing enterprise;
  • Replacing employees laid off due to structural changes, technological changes, economic reasons, or through division, separation, merger, or consolidation.
  • The labor subleasing party may not transfer subleased employees to other employers; may not use subleased employees provided by enterprises without a License for Labor Subleasing.
