Labor leasing is when an employee enters into an employment contract with a labor-using enterprise, which is a labor leasing enterprise, and then the employee is transferred to work under the management of another labor user while still maintaining the employment relationship with the labor leasing enterprise.

Thus, during the employment contract process, there are 03 parties involved. These parties include:

  • Labor leasing enterprise: A labor leasing enterprise is a business established in accordance with the Law on Enterprises, granted a license for labor leasing activities, recruits, enters into employment contracts with employees, and then transfers employees to work under the management of another labor user while still maintaining the employment relationship with the enterprise that entered into the employment contract (referred to as the labor leasing enterprise).
  • The labor lessee is a business, agency, organization, cooperative, household, and individual with full civil act capacity, using leased labor for certain jobs permitted for labor leasing within a certain period.
  • Leased labor is an employee with full civil act capacity, recruited by the labor leasing enterprise and entered into an employment contract, and then transferred to work under the management of the labor lessee.

According to Article 52 of the Labor Code of 2019: The activity of labor leasing is a conditional business sector, only conducted by enterprises with a Labor Leasing Operation License and applicable to certain jobs.

Specific conditions are as follows:

According to Article 54 of the Labor Code of 2019:

  • The labor leasing enterprise must make a deposit and be granted a Labor Leasing Operation License.
  • Comply with the deposit and list of professions as regulated by the Government.

  • Has registered and been granted a business license in the field of human resources and labor leasing as regulated. Including:
  • The legal representative is directly the business manager as regulated by the Law on Enterprises.
  • Has experience in professional and management in the field of human resources and labor leasing.
  • Has made a deposit at a Commercial Bank according to Decree 145/2020 of the Government.

Nosouno adheres to the principles of labor leasing activities according to Article 53 of the Labor Code of 2019 as follows:

  • The maximum duration of labor leasing for an employee is 12 months.
  • The labor lessee is allowed to use leased labor in the following cases:
  • To temporarily meet the sudden increase in labor demand within a certain period;
  • To replace employees during maternity leave, occupational accidents, occupational diseases, or to perform civic duties;
  • To use labor with high professional and technical levels.
  • The labor lessee is not allowed to use leased labor in the following cases:
  • To replace employees who are on strike or resolving labor disputes;
  • Without a specific agreement on compensation for occupational accidents and diseases of leased labor with the labor leasing enterprise;
  • To replace employees dismissed due to restructuring, technology changes, for economic reasons, or due to division, separation, merger, consolidation.
  • The labor lessee is not allowed to transfer leased labor to another labor user; not allowed to use leased labor provided by enterprises without a Labor Leasing Operation License.
